Crime does not take a holiday nor do the men and women of law enforcement who are duty-bound to protect the lives and property of those who live within their jurisdiction. For federal agents the “jurisdiction” is the entire United States of America!Old habits die hard! Although retired law enforcement officers no longer report for duty, as a group we remain concerned and committed to the mission that occupied our waking hours for the duration of our careers.
Yesterday, December 24, 2012 I received a brief e-mail from a former colleague at the INS (Immigration and Naturalization Service) who is also a retired Senior Special Agent. In addition to conveying his holiday wishes for my family and me, he provided me with a link to an infuriating Boston Globe news report that was entitled,
Many freed criminals avoid deportation, strike again
The vast and secretive US prison system for immigrants, stymied when it tries to deport some criminals, has quietly released thousands, including killers, a Globe investigation shows

This report is lengthy and make so many important points that I will not attempt to delve into each and every point here but ask that you please take the time to read this report in its entirety and then I ask that you forward this e-mail to everyone you can and ask them to do the same.
I will, however, provide you with the first few sentences of this report:
FLUSHING, N.Y. — Qian Wu thought the man who brutally attacked her was gone forever.
She was sure that Huang Chen, a Chinese citizen who slipped into America on a ship and stayed in the country illegally, would be deported as soon as he got out of jail for choking, punching, and pointing a knife at her in 2006.
But China refused to take Chen back. So, after jailing Chen on and off for three years in Texas, immigration officials believed they were out of options and did what they have done with thousands of criminals like him.
They quietly let him go.
Nobody warned Wu, or prosecutors, or the public. The petite, 46-year-old woman learned Chen was still here when he stormed into her unlocked apartment one day in January 2010 and announced, “I bet you didn’t expect to see me.” Terrified, she called the police, and he fled. But for two weeks, Chen was free to stalk her and finally, to catch her as she hurried home with milk and bread one afternoon.
Chen then finished what he had started earlier, bashing Wu on the head with a hammer and slashing her with a knife. As she lay crumpled in a grimy stairwell, he ripped out her heart and a lung and fled with his macabre trophies.
“She lived in horror in the last two weeks of her life,” said Yongwei Guo, Wu’s widower, through an interpreter in New York. “She knew there was somebody coming to kill her and we asked the police for protection, and also the government, but they did nothing.”

The issue that advocates for open borders and for vast amnesty programs for unknown millions of illegal aliens whose true identities, backgrounds, and potential threat to national security and community safety and national security blithely ignore is the fundamental reason that America’s immigration laws were enacted in the first place- to protect innocent lives and protect the jobs of American workers. I have come to refer to these advocates as being “Immigration Anarchists.”
Among these Immigration Anarchists are “journalists” who exclaim horror at the mere suggestion that a law enforcement officer would engage in profiling yet they often appear sanctimoniously on the alter of the television camera to postulate that the only way for politicians to win the mythical “Latino vote” and the vote of ethnic American voters is to support massive amnesty programs and not support the enforcement of the immigration laws of the United States!
These Immigration Anarchists also often claim that those who favor secure borders and effective immigration law enforcement do so out of racism and a hatred for Latinos.
Their motto should be. “Don’t confuse me with the facts!”
If you are familiar with my writings and the testimony I have provided before various Congressional hearings in Washington and hearings conducted before state legislative bodies across the country know that I have frequently made the point that contrary to the claim that America has four border states, the United States actually has 50 border states. Any state that has an international airport or a seaport is as much a border state as are those states that are found along the northern and southern borders of the United States.
The excerpt from the news report that I provided above illustrates these points. The criminal alien upon whom the opening paragraphs focused, Huang Chen, was apparently a ship-jumper from China. He did not run the US/Mexican border. He was not a citizen of Mexico and certainly was not a member of the Latino community.
Although the ethnicity of his victim, Qian Wu was not noted in that brief passage, it is reasonable to assume that she was also a member of the ethnic Chinese community. This is not atypical. The most likely victim of crimes committed by criminal aliens are people who are of the same ethnicity and often citizenship.
As an INS Special Agent I often investigated and arrested aliens who were not from Mexico or even from Latin America. The immigration laws make no distinction where race, religion or ethnicity are concerned. The only distinction is between foreign nationals present in the United States that, under the Immigration and Nationality Act (INA) defines such foreign nationals as being “Aliens.” In fact, the definition of an alien, as provided in the INA is simply, “Any person, not a citizen or national of the United States.”
There is absolutely no insult to be found in that definition- only clarity. For Immigration Anarchists clarity is dangerous- it makes it impossible for them to push a position that facts, commonsense, morality and our immigration laws contradict!
Immigration Anarchists will argue that not all aliens are criminals and that there are Americans who were born in the United States who are criminals. The make the same sorts of assertions about terrorists. (I wish I had a dollar for every time I have heard them mention Timothy McVeigh, the notorious bomber who destroyed the Alfred P. Murrah Federal Building in Oklahoma City on April 19, 1995 and, in so doing, killed so many innocent victims.
There is no argument that Americans commit acts of extreme violence, however, is it not reasonable to attempt to prevent as many criminals from entering the United States and killing innocent victims?
Many prisons are referred to as “Correctional Institutions” as though they are in the business of preventing recidivism. Certainly efforts are made to achieve this worthwhile and important goal, however, many criminals do commit more crimes when they are released from prison. Where criminal aliens are concerned, deporting such criminals can be the most effective tool to prevent them from committing more crimes in the United States. When our government fails to remove (deport) criminal aliens and then turns them loose onto the streets of cities and towns across the United States, the likely outcome will involve more crimes and more victims.
On December 22, 2009 I debated an immigration attorney of Fox News’ “Fox & Friends” about the sanctuary policies of San Francisco whereby illegal aliens who had been convicted of drug related crimes could have their criminal histories expunged if they agreed to take English Language training so that they could then get jobs in the United States!

I made the point back then and I make the same point now- the best antidote for recidivism where criminal aliens is concerned is to deport the criminal alien and have local and state law enforcement officials work cooperatively with ICE to identify aliens who are deported so that they can be taken into custody and seek to have them deported rather than simply release them back out onto the street where they may well victimize more innocent people.
In the early 1980’s I decided to approach then New York’s Senior Senator, Alphonse D’Amato to accomplish three goals where immigration law enforcement was concerned-
1 – Prioritize the arrest and deportation of criminal aliens.
2 – Amend the immigration laws to make the illegal re-entry of criminal aliens who are deported a distinct crime with a maximum penalty of 20 years in prison rather than the 2 year maximum the law mandated for all such previously deported aliens.
3 – Conduct deportation hearings inside the various prisons around the United States so that aliens could be ordered deported during their first year of incarceration so that by the time they served out their criminal sentences they wold have hopefully run the entire appeals process and could simply be put on an airliner upon the completion of their sentences rather than first appear before an Immigration Judge and likely be released pending the outcome of their deportation proceedings. Such aliens who are released often abscond and, while at large, attack and injure or kill more innocent victims.
All three of my suggestions were implemented but, as is often the case where immigration is concerned, adequate resources were never appropriated for these programs.
Illegal immigration is not a “Victimless Crime!”

On Thursday, November 3rd of this year Representative King, Representative Walter B. Jones and members of the Tea Party Immigration Coalition, the Federal Immigration Reform and Enforcement (FIRE) Coalition and the Foreign National Crime Information Center which administers a website that tracks homicides committed by illegal aliens on the Victims of Illegal Alien Crime Memorial, held a news conference in Washington, D.C., to discuss the issue of innocent lives lost to the failures of our nation to effectively enforce and administer our nation’s immigration laws. Below I have attached a copy of a letter to President Obama from the leaders of the Tea Party Immigration Coalition and the Federal Immigration Reform Enforcement Coalition asking that this November 6th and from now on, every November 6th be declared a “Day of Remembrance for the Victims of Illegal Aliens.”
I was gratified that during the course of the news conference for which I included a link to the video, that Congressman King noted that my testimony at a Congressional hearing in which he asked me about the number of victims of criminal aliens prompted him to request that a pair of GAO studies and reportes be prepared. It is good to know that some members of Congress do pay attention to information that is provided at those hearings!
The most important mission that any government has to be successful at is to provide for the safety and well-being of its citizens. The effective enforcement of our immigration laws are a vital component of that mandate. It is outrageous to refer to the enforcement of these laws as being “anti-immigrant!” It is through these laws that each and every year more than 1.1 million aliens are granted lawful immigrant status and placed on the pathway to United States citizenship. The immigration laws provide for national security and community safety- but only if they are effectively enforced and administered.
It is not xenophobic to secure our borders and enforce our immigration laws- it is, however, insane not to!
The immigration laws are supposed to achieve two primary goals- to protect American lives and protect Americans’ jobs.
Our nation is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world. However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda or other terrorist organizations!
It is also vital that American workers never be made to compete with foreign workers for their jobs! (This requirement is a component of the Immigration Laws that are not being enforced today!)
If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws that are intended to protect our nation and our citizens concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation!
We the Peoplemust make it clear to our politicians that we are not as dumb as they hope we are!
We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.
This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!
You are either part of the solution or you are a part of the problem!
Democracy is not a spectator sport!
