As conservatives bask in the glow of a new morning in America, we mustn’t lose sight of a consequential, ongoing news story that deserves our attention.

Opening statements began last Friday in the trial of Daniel Penny, a 25-year-old former Marine who faces up to 19 years in prison on charges related to the death of Jordan Neely, a homeless, mentally ill Michael Jackson impersonator who was (insert obligatory “allegedly”) threatening passengers on a New York City subway in May 2023 until Penny subdued him in a chokehold. Neely died later at the scene.

Penny’s lawyers Thomas Kenniff and Steven Raiser are arguing that he acted to protect the other passengers from Neely, whom one witness described as ranting in an “insanely threatening” way, including declaring “I want to hurt people,” that “someone is going to die today,” and that he wanted “to go to prison.” Court documents from the incident indicate that fellow passengers feared for their lives, The Daily Wire reported.

Penny’s attorneys are not only arguing that their client’s chokehold was justified due to this menacing behavior, but are also questioning whether the chokehold even caused Neely’s death. The medical examiner never provided specific evidence to support the claim that Neely died of asphyxiation, the New York Post reported.

“Some people say I was trying to choke him to death, which is also not true. I was trying to restrain him,” Penny has said, according to The Daily Wire. “You can see in the video there’s a clear rise and fall of his chest, indicating that he’s breathing. I’m trying to restrain him from being able to carry out the threats.”

But prosecutors in the Manhattan office of Left-wing activist District Attorney Alvin Bragg don’t need to prove Penny intended to kill in order to convict him. They only need to convince jurors that Penny “recklessly” caused Neely’s death, whereupon they can convict Penny of second-degree manslaughter.

The Biden-Harris administration, which just lost an election to Trump, is preparing to wind down the various legal cases that it had pending against him.

The official reason is that a president can’t be prosecuted. But if that were the case, why was Trump beleaguered with an ‘independent prosecutor’ when he was in office to begin with? Democrats had spent years promising to bring President Trump to ‘justice’ while he was a sitting president.

The prosecutions and investigations of Trump were election interference all along. Since there are no more elections to interfere with, there’s no longer any point in pursuing them.

That’s not to say other ‘investigations’ won’t emerge, but they’ll be targeted to interfering with the actions and policies of the Trump administration rather than trying to sell the public on the notion that he’s a ‘felon’ who has committed crimes.

The investigations of Trump were election interference from the very beginning. Russiagate was generated by the Clinton campaign in partnership with the Obama administration to justify spying on the campaign, smearing Trump and going after his associates. Russiagate lingered on to target Trump associates. But the Jack Smith election interference campaign is really no good for any of that.

It’s tempting for me to say this isn’t a surprise.

Back in May last year, I predicted “Trump’s second act,” telling Spectator readers: “He can still win, in spite of everything.” My point was that the Democrats’ strategy of lawfare against Donald Trump was highly likely to backfire. “If Lula [da Silva] can come back from one-and-a-half-years in jail to win” the Brazilian presidency, I wrote, “Trump may have little to worry about, as there isn’t the slightest chance of his being locked up between now and Election Day next year. Indeed, the perception that Democratic operatives are using the legal system for political ends will likely help him win votes.”

“Joe Biden,” I concluded, “is in serious danger of following Gerald Ford, Jimmy Carter, and George H.W. Bush into the bin marked ‘one-term presidents.’ ” 

Last week, too, I was ready to predict that Kamala Harris was destined for the bin marked “incumbent vice presidents who lost.”

Nevertheless, I am surprised by the scale of Trump’s win. 

They used to call Bill Clinton “the Comeback Kid.” He cut a forlorn figure these past few days, trying feebly to drum up enthusiasm for the Democrats’ worst candidate since George McGovern. Well, move over, Bill. There’s a new Comeback Kid in town. Except that Trump is the Comeback King.

This is a bigger comeback than Grover Cleveland’s in 1892, when he became the first—and, until last night, only—American president to win a second nonconsecutive term. This is a bigger comeback than Richard Nixon’s, when he was elected president in 1968, eight years after he lost by a dubious whisker to John F. Kennedy. It’s bigger than Winston Churchill’s multiple comebacks, the biggest of which were in 1940 and 1951. It’s bigger than Charles de Gaulle’s in 1958. It’s bigger than Napoleon’s Hundred Days in 1815. In fact, I am tempted to say that the only comeback it’s not bigger than is the Resurrection.

According to reports, since 2009, Muslims, inspired by Boko Haram, have murdered more than 150,000 Christians in Nigeria.

Chad, Libya, Sudan, the Central African Republic, Cameroon, Nigeria and Niger all struggle with jihadist insurgencies.

The ongoing civil war in Sudan between the Sudanese Armed Forces and the Rapid Support Forces, for example, poses a serious threat to Chad’s stability. As Sudan’s civil war escalates, it fuels further turmoil in the region.

The civil war in Sudan has driven around 700,000 refugees into Chad, creating a humanitarian crisis and impeding trade between the two countries.

As a result of jihadi violence by terror groups in sub-Saharan Africa, 16.2 million Christians have been forcibly displaced. An Open Doors report quotes Pastor Barnabas, who lives in a displaced persons camp in Nigeria: “Millions of Christians are displaced, here in Nigeria. Millions of Christians are displaced in Africa. The news doesn’t care about it, politicians don’t talk about it, governments don’t talk about it, global politics don’t talk about it. Nobody talks about it.”

Lebanon: Massive ‘Underground Combat Sites’ by Bassam Tawil

These tunnels facilitate the movement of heavy equipment, missiles, and fighters and even allow missiles to be launched from within.

Built beneath the border between Lebanon and Syria, these tunnels allow Hezbollah’s smuggling unit and the Iranian Revolutionary Guard’s Quds Force to transport ammunition, supplies, and fighters under the border.

Many of these tunnels are located beneath civilian infrastructure and populated areas, using civilians as human shields for their activities.

Hezbollah and Hamas bear full responsibility for the death of thousands of Lebanese and Palestinians since the October 7, 2023 massacres… The two terrorist groups started the war, at the behest of their patrons in Iran, with the intention of killing a large number of Israelis and eliminating Israel. The vast network of tunnels they built in Lebanon and the Gaza Strip are an indication of the terrorist group’s determination to pursue their Jihad (holy war) against Israel, notwithstanding the risks to the Lebanese and Palestinian people living under their rule.

Even if Hezbollah say they will withdraw to north of the Litani River, the tunnels enable it easily to violate that pledge with no one above ground the wiser. Hezbollah, moreover, never abided by UN Resolution 1701 to stop building tunnels and storing weapons in south Lebanon.

The current war in Lebanon and the Gaza Strip must not end without the destruction of all the tunnels and the total defeat of Hezbollah and Hamas. Those who are pushing for an immediate ceasefire are only empowering the Iranian regime and its terror proxies, paving the way for another October 7-style massacre. The defeat of Hezbollah and Hamas will benefit not only Israelis, but the Lebanese and Palestinians, as well.

The Iran-backed terrorist organization Hezbollah, as part of its preparations for war with Israel, spent the past 15 years building a vast network of tunnels in Lebanon. Some of the tunnels were supposed to be used for invading Israel to carry out atrocities against Israelis like the ones committed by Hamas, another Iran terror proxy, on October 7, 2023.

The stakes of the 2024 election could be very high depending on who wins. I don’t approve of either of the two candidates — I think they’ve both committed impeachable offenses and demonstrated unfitness. I’m voting for Trump. That’s not an endorsement, it’s just how I’ve resolved the choice — I don’t understand how any conservative could support Harris, but I sympathize with those who can’t vote for Trump.

Do I think Trump would appoint better people than Harris would, including a number of strong conservatives? I do indeed. Trump is not a committed conservative, but his last administration had much for conservatives to like; and even if I don’t have hopes as high for a new Trump-Vance administration, I’m convinced a Harris-Walz administration would be a disaster for the country.

But here is my main calculation: The system’s guardrails — Congress, the courts, the administrative state, the armed forces, the state governments, the media, and business leaders — are zealous in policing against executive excess when a Republican is in power. The worst thing Trump did was the soft coup attempt, and it never had a smidgeon of a chance. By contrast, the guardrails are not nearly as effective in checking executive overreach, usurpation, and other abuses of power by Democrats — in fact, many of the institutions we rely on as checks become, instead, progressive cheerleaders. As a result, I have considerably less trepidation about a Trump presidency than a Harris presidency.

The most iconic image of the 2024 campaign came from the Butler Farm Show Grounds in Pennsylvania on July 13.  An assassin had just fired multiple shots at President Trump, wounding him in the ear.  Secret Service agents scrambled to shield the president, while counter-snipers neutralized the shooter.  As members of his security detail began to briskly move him from the stage where he was speaking, President Trump asked them to stop so that he could reassure supporters he was alive and well.  With blood streaked across his face and pooling near one side of his mouth, he stretched a closed fist toward a blue sky with an American flag waving just behind his head and shouted to all who could hear, “Fight!  Fight!  Fight!”

Arguably, it was not just the most iconic visual of the campaign, but also one of the most iconic images in American history.  The picture of a bloodied but defiant American president reaching toward the heavens and expressing a sense of resolute calm in a moment of chaos will remain in many people’s minds for the rest of their lives.  President Trump’s bravery is seared in their memories. 

In any other election cycle, the contest would have ended on July 13.  On a sunny day during a festive campaign rally, a shooter murdered a husband and father protecting his family, injured two other attendees critically, and nearly assassinated a former president.  Such outrageous political violence should have sufficiently shifted public sentiment toward Trump’s favor to make his victory a foregone conclusion.  (For what it’s worth, President Biden dropped out of the race eight days later.)  Fearing that possibility, the propaganda press immediately worked to erase the incident from the public’s thoughts.  

After becoming one of the most famous photographs in the world, the image of President Trump’s raw courage disappeared from publications and websites.  Reporters barely talked about the murder of local Pennsylvanian Corey Comperatore or the serious injuries to other rallygoers.  Anonymous FBI sources initially downplayed the attempted assassination by speculating that Trump had not actually been shot but had instead been cut by flying pieces of broken glass.  Cable news pundits openly mocked the bandaging around Trump’s ear and acted as if being shot in the face is no big deal.  To this day, FBI investigators preposterously claim that they are unable to ascertain the shooter’s motive.

Thomas Hogan Is the Era of Progressive Prosecutors Ending? Voters in several major American cities have an opportunity to revamp public safety on November 5.

We all know that the presidential election is looming, but for a few big cities, a crucial down-ballot vote—for the office of chief prosecutor—could have a major effect on the day-to-day safety of their citizens.

In Los Angeles, America’s second-largest city, voters will decide whether to oust radical prosecutor George Gascón. Gascón barely made it through his first term, surviving two recall efforts based on technicalities. Soaring crime rates and a general sense of disorder have led even progressive Angelenos to say that enough is enough.

Gascón is opposed by Nathan Hochman, a former federal prosecutor who has promised to pursue policies that treat those who commit crimes as criminals. In current polling, Gascón trails Hochman by 24 points. In a last-minute Hail Mary, Gascón has decided to support re-sentencing and clemency for the notorious Menendez brothers, convicted of the brutal murders of their parents, despite their claims having been repeatedly rejected by the courts. Election Day will decide whether Los Angeles is ready to start rebuilding.

Meantime, heading north in California, another critical chief prosecutor is on the ballot: Pamela Price in Oakland. Price, along with Oakland’s mayor Sheng Thao, is facing a recall election after just two years in office. Many Oakland voters have expressed the same buyers’ remorse as their neighbors across the bay in San Francisco, who recalled progressive prosecutor Chesa Boudin after a few years in office, amid spiraling crime and disorder.
