A recent Rasmussen poll of 1,200 registered voters showed that a majority of those surveyed favor legal immigration. But the same number of people disagree, and many also support an increased presence of law enforcement and the military at the nation’s borders.

According to a piece in Just the News, 74% agree that legal immigration is a positive thing, while the same percentage of respondents said that illegal immigration is a negative one. The article said that 61% of those polled believe that Title 42 should be used to keep illegals out of the U.S. to limit the spread of COVID-19. One in five of those polled believed that the border is secure, while most said it is not, by a difference of 21% to 54% Most respondents (52%) said that Democrats are not serious about the issue.

On the other hand, 43% said that Republicans were trying to solve the problem. Seventy-three percent agreed that problems like national security issues, drugs, and human trafficking are attributable to illegals who evade capture by CBP officers. Seventy-five of those who responded said that the cartels deserve the designation of terrorist organizations.

Notably, the poll asserted that around 75,000 people enter the U.S. every month and avoid apprehension. There was no attribution for that statement, but with that in mind, 68% of respondents said that it was time to deploy law enforcement and military personnel to the border.

The Supreme Court stayed a trial judge’s ruling that would have ended Title 42 and has, for the time being, allowed the rule to remain in place. The court issued an unsigned 5-4 opinion that was a victory for the 19 states that had sued the federal government to keep Title 42 in place.

Title 42 is a 1940s-era rule that limits immigration and asylum seekers during a national health crisis. It was originally put in place by Donald Trump in March 2020 and severely restricted the number of people seeking asylum by expelling all but a fraction of those who showed up at the border.

Joe Biden eased the restrictions, but about 65% of all asylum seekers who showed up at the border were still expelled.

The stay says nothing about the lawsuit by GOP states seeking to keep Title 42 in place.

The court said that it would hear arguments in the case in February and that the stay would remain in place until it issued its ruling. The justices said they would only address the question of whether the 19 mainly Republican-led states that had sought the stay could pursue their challenge to the measure.

This week could mark the most consequential development on the U.S.-Mexico border since January 2021, when President Joe Biden essentially opened the nation’s doors to millions of illegal border crossers. Depending on how court fights turn out, Title 42, the Trump-era measure that allows the U.S. government to quickly return illegal crossers to Mexico on the grounds of preventing the spread of COVID, will likely soon expire. After that, officials expect a flood of illegal crossers, all coming into the United States confident that they, like hundreds of thousands before them just this year, will be allowed to stay.

The disaster will come on top of the Biden administration’s currently disastrous border policy. In fiscal year 2022, the period from Oct. 1, 2021 to Sept. 30, 2022, Border Patrol agents encountered a record number of migrants crossing illegally into the United States — 2,378,944. Add onto that the estimated 600,000 illegal crossers who got away without any contact with the Border Patrol, and that means close to 3 million border crossers in a single year. The two months since the beginning of the new fiscal year have seen crossings at an even higher rate. And that is before the Title 42 change.

Already, the numbers have risen to unheard-of levels. Recently the Border Patrol reported encountering 16,000 migrants in just 48 hours — 8,000 per day. Compare that to the assessment of Jeh Johnson, President Barack Obama’s head of homeland security, who once said that 1,000 encounters a day constituted a crisis. Now, there are predictions that post-Title 42 encounters might hit as many as 14,000 a day.

Cities and towns along the border have been overwhelmed since the Biden changes took place. Look at these figures from El Paso, Texas, in a story by the Washington Examiner’s Anna Giaritelli: “According to all the data that are publicly available from the city, the 678,000 residents of El Paso have seen 84,082 immigrants released into their town between August 22 and December 11.” That’s an extraordinary influx in the last few months, repeated in other U.S. communities along the border.

The late, great Rush Limbaugh frequently opined on his radio show that progressivism’s appeal stems from the fact that its followers are required to do nothing but “care.” Simply vent empathy or outrage—especially on social media—on behalf of an approved left-wing cause, and your otherwise dreary life can seem meaningful in the belief you are both morally superior to your ideological opponents and also saving the world. It’s a seductive pitch that has been all too successful.

The political benefits of this ideology have not been lost on state and local elected leaders, many of whom are true believers anyway. They enthusiastically virtue signal on behalf of numerous issues, and one of their favorites is sanctuary policies as a purported act of mercy toward illegal aliens. For years this was populism on easy mode, as politicians basked in the approval from their activist base without having to do much hard work.

Thanks to a combination of the Biden Administration’s disastrous border policies and fed-up red state governors, however, the party is over as sanctuary rhetoric is crashing into reality, and the curtain is being pulled back to expose their folly.

Evidence of this phenomenon can be seen even in the words of immigration realpolitik coming from the most unlikely places. In California, a hotbed of irrational sanctuary policies, Governor Gavin Newsom recently toured the southern border of his state and warned of dire consequences should the White House succeed in its effort to end Title 42 border enforcement.

“The fact is, what we’ve got right now is not working and is about to break in a post-42 world unless we take some responsibility and ownership,” Newsom said.

Responsibility? Ownership? These are uncharted waters for Newsom. He has spent most of his governorship pandering to noncitizens with initiatives like universal healthcare and state IDs for illegal aliens. For someone like Newsom to be warning that the end is near is a sign that we may be approaching a point of no return with Biden’s border sabotage.

Big-city mayors, in particular, have benefited from being sanctuary advocates. They’re now admitting the obvious truth that sanctuary policies are unsustainable. Since Governors Greg Abbott of Texas, Ron DeSantis of Florida, and Doug Ducey of Arizona began sending busloads of migrants to New York City, Mayor Eric Adams has been forced to walk a tightrope of defending sanctuary policies while acknowledging his city is struggling to accept the new arrivals.

Just in the nick of time, Chief Justice John Roberts has placed a hold on a lower court decision to end the Centers for Disease Control and Prevention’s Title 42 power at the U.S. border. That staves off an expected massive wave of illegal immigrants from crossing into the U.S., at least for now. But, while Roberts’ move is welcome, this doesn’t end the border crisis.

Under the Title 42’s authority, the U.S. can expel illegals to prevent spread of COVID, which many health officials believe is set to spike again as winter arrives this week. Title 42 has been one of the few effective tools border officials can use to prevent another massive surge in illegal immigrants.

Unfortunately, a bit over a month ago, a lower court struck down Title 42. Rather than fight, the Biden administration made a token display of asking to keep it in place, but just for five weeks. Now, time’s up. So Roberts’ emergency stay, which comes at the request of 19 state attorneys general, has staved off a bigger border crisis.

But for how long? Biden wants Roberts to overturn his ruling, letting Title 42 expire just after Christmas. It’s not hard to figure out why. His policies have essentially erased our southern border. He’ll keep the chaos going to irritate Red State governors on the border and the newly elected House Republican majority, but also, some say, to cynically boost Democratic voter ranks.

How bad could it get? The Biden administration itself has predicted that the flood of humanity coming into our country illegally could soon reach 500,000 a month or more. That’s nearly a 120% increase over fiscal 2022’s record of 230,000 a month.

It’s even worse than predicted.El Paso Mayor Oscar Leeser declared a state of emergency after conferring with federal officials about the thousands of illegal aliens who are in El Paso, waiting to be released into the United States.

There is no room for them in the overflowing shelters, so thousands of them are sleeping in the streets. Or, sleeping in the sewers.

“Talking to some of our federal partners they really believe that on Wednesday our numbers will go to 4-, 5- or 6,000, and when I asked them, I said do you believe that you guys can handle it today, the answer was no. And when I heard the answer was no, I knew we had to do something right away,” Leeser said. (emphasis added)

Why can’t they handle it? The Biden administration has known since the summer that Title 42 was going to end. They have known since the beginning of May that they were facing an unprecedented crisis — up to 18,000 illegal aliens a day showing up at the border.

DHS Secretary Alejandro Mayorkas told America back in May, no worries, we’re on it.

“What we do is we prepare and we plan, and we’ve been doing so for months understanding that the Title 42 authority that the CDC holds is not going to be around forever because, quite frankly, we want to conquer the pandemic and put it behind us,” Mayorkas said on CNN’s “State of the Union.”

As it turns out, that was a lie.

El Paso represents but one crossing point for illegals in Texas. There are 28 main border crossings in that state alone. And if they’re getting slammed with 6,000 illegals arriving every day in El Paso, 18,000 illegals a day along the entire southern border is an optimistic number.

The Biden administration would have you think that the large numbers of migrants crossing into the U.S. illegally is just ‘seasonal,’ the border is “secure,” and every one of these illegal migrants has a ‘right’ to an extended and cost-free asylum hearing process extending for years, not including appeals, with free work permits in the interim.

Incentives put out by the Biden administration to come on over  — shutting down construction of the border wall, ending the Remain in Mexico policy, ending the Trump-era treaties with Central America, halting deportations, extending benefits, free transport, free cell phones, free medical care, free hotels, free vaccines, plus zero jailtime for breaking and entering, would have nothing to do with it.

Well, with word out that Title 42 expulsions on COVID concerns is ending as of December 21, that pretty well puts paid to the nonsense that there’s nothing unusual about the large numbers of foreign nationals making a rush to the U.S. border to get in while the getting’s good.

The migrants have heard the message about the end of Title 42 … and they are coming.

The Biden administration has no plan for what to do beginning next week when it loses the ability to quickly expel illegal immigrants.

As the year winds down, the border is about to break wide open. In less than a week, the Biden administration’s last remaining tool to control illegal immigration, left over from the Trump administration, will be taken away.

Title 42, the public-health order invoked by President Trump during the pandemic that allowed immigration officials to quickly expel most migrants caught crossing the border illegally, will end on Dec. 21 by order of a federal judge.

Once Title 42 is gone, federal agencies at the border will have no choice but to process and release nearly every illegal border-crosser. It will represent a full return to the Obama-era “catch-and-release” policy. Border Patrol estimates they could see as many as 14,000 arrests per day in the coming weeks, which would totally overwhelm the border.

For migrants, there is now every incentive to do just that. Word of Title 42’s demise has almost certainly reached migrants in Mexico already, who now know that if they cross the Rio Grande, they will be allowed to remain in the United States, with work authorization, for years while they await the outcome of an asylum hearing.
