Speaking to reporters in the White House briefing room Monday afternoon, newly confirmed Department of Homeland Security Secretary Alejandro Mayorkas attempted to blame the current unaccompanied minor crisis on the Trump Administration, rather than President Biden’s recent open border executive actions. 

Mayorkas invited illegal immigrants to eventually make the trip to the United States, just not right now. He also denied there is currently a crisis at the border, which is false. In fact, the Biden administration recently opened additional detention facilities to handle the overflow of unaccompanied minors. In January 2021, nearly 6000 minors came across, the largest number in years. Officials predict 13,000 minors will come in May, just a few months from now. 

Reporters have been barred from visiting newly opened detention facilities. DHS officials are citing “COVID restrictions” as the reason why.

Officials from the United Nations helped usher Mexican migrants into the United States last week after President Joe Biden reversed his predecessor’s Migrant Protection Protocols, otherwise known as the Remain in Mexico program.

Footage from the Daily Mail below shows migrants being escorted into the states by people wearing vests often associated with UN officials who promote resettlement.

A local CBS affiliate in south Texas confirmed the UN’s presence as migrants began crossing the Gateway International Bridge into the border town of Brownsville, Texas, with the help of UN officials who screened migrants for COVID-19 upon entry. According to CBS, at least 25 migrants successfully crossed into the United States last week, with immigration attorney Jodi Goodwin reporting that more are on the way.

The border crisis that anyone could have seen coming is finally here, thanks largely to the actions of the Biden administration over the past few months. It turns out that promising to roll back Trump-era immigration restrictions, signing a raft of executive orders to that effect, and then introducing a mass amnesty bill sends the message that if you can get across the U.S.-Mexico border, you can stay.

Plenty of families in Mexico and Central America have gotten the message. According to a recent report in the Washington Post, for the past four months U.S. Border Patrol has taken into custody more than 70,000 illegal immigrants a month—the most for this period in a decade.

A growing number of those are children. Since November, the number of minors in federal custody has tripled to 7,000 after the Biden administration decided it would stop expelling minors and teenagers apprehended at the border without their parents. One official from the Department of Health and Human Services told Axios on Thursday, “We’re seeing the highest February numbers than we’ve ever seen in the history of the [Unaccompanied Alien Child] program.”

To cope with the surge, the administration has had to re-open an emergency shelter in Carrizo Springs, Texas, that was last used during the 2019 border crisis. Back then, the Trump administration was condemned by Democrats and the corporate press for keeping “kids in cages.”

The cages are back, but now they’re being called “facilities.” White House Press Secretary Jen Psaki tried hard this week to spin the re-opening of the Texas facility as “absolutely not the same” as when the Trump administration used it. The emergency shelter is needed now, she said, because of COVID-19 precautions that require social distancing.

Joe Biden, the open borders president, is proposing amnesty legislation to provide the 11 million plus illegal aliens in this country a pathway to citizenship. During his CNN-hosted town hall meeting on February 17, Biden confirmed that such a pathway for citizenship must be included in any immigration bill that he would consider signing. The term “alien” would no longer be used in U.S. immigration law. Until the illegal aliens successfully complete the path to U.S. citizenship under Biden’s “reform” legislation, they are to be referred to as “noncitizen,” which is defined as “any person not a citizen or national of the United States.” 

In the meantime, through executive action, Biden is handcuffing Immigration and Customs Enforcement (ICE) officers in arresting and detaining illegal immigrants in the United States for eventual deportation. U.S. District Judge Drew Tipton at least managed to slow things down a bit. He issued a nationwide preliminary injunction on February 23rd against moving ahead with implementation of Biden’s 100 day pause on most deportations. But Biden’s political appointees at the Department of Homeland Security (DHS) are undoubtedly searching for any loophole they can find.   

Biden is allowing some migrants seeking asylum, who have waited in Mexico for months under the Trump administration’s  “Remain in Mexico” policy, to enter and remain in the United States pending adjudication of their asylum applications. The catch and release policy is back as the aliens melt into communities across the country, where they can compete for jobs with unemployed U.S. citizens and increase the risk of further coronavirus spread.

Biden’s immigration policies are a disaster in the making, and he is just getting started.

Immigration, a top issue before and during the Trump presidency, has become much less of a concern for Americans over the past year due to the primacy of the pandemic and the ensuing economic shutdown. That, combined with the press’s lackadaisical approach to covering the Biden administration, means there hasn’t been enough media scrutiny of Biden’s incoherent border policy.

Frequently the Biden administration’s words do not match its actions, primarily because it does not seem to understand that policies have real-world consequences. For example, after Biden campaigned on loosening Trump’s stricter enforcement of immigration law, thousands of Honduran migrants formed a caravan to come to the US in hopes of gaining entry. The Biden team tried to put the genie back in the bottle. An unnamed transition team official told NBC News that migrants ‘need to understand they’re not going to be able to come into the United States immediately’.

Such messages are meaningless of course, unless they are accompanied by an actual policy change to eliminate the pull factors that incentivize migrants to attempt to cross the border. Instead, after taking office, Biden proposed legislation that would grant amnesty to 11 million illegal immigrants already in the country, signed a memo upholding DACA and is phasing out the Migrant Protection Protocols program.

When President Biden signed his executive order for a review and update to ICE enforcement procedures, he also put Operation Talon on hold. Operation Talon is a  nationwide ICE operation that arrests and removes convicted sex offenders illegally in the United States. The effects of this order have been immediate, with the cancelation of a joint operation to arrest at-large sex offenders:

ICE had been planning a nationwide operation in partnership with the U.S. Marshals targeting at-large sex offenders, but it was scuttled by the new directive. According to one of my ICE sources, most of the targets do not clearly meet the new standards, especially in California, where sex offenders routinely get to plead down to far lesser charges, especially if it helps them avoid deportation, and where certain sex crimes, such as sex with a minor, are not classified as felonies as they are in other states. Another ICE officer told me that they had more than two dozen deportable sex offender targets at large in his area who now will be free to re-offend.

As Biden has essentially thrown open the border to migrant caravans and the cartels that traffic human beings over the border, reducing the enforcement in this area is appalling. His executive order halted most immigration enforcement, with “aggravated felons” being the notable exceptions—but only if their aggravated felony occurred in the last ten years. According to a list compiled by the Center for Immigration Studies, illegal immigrants with the following convictions and in the following numbers will no longer meet the criteria for deportation:

Sexual Assault: 1,478
Sex Offense: 825
Smuggling Aliens: 603
Lewd or Lascivious Acts with a Minor: 505
Kidnapping: 305
Sexual Exploitation of a Minor: 231

U.S. Immigration and Customs Enforcement officers will need preapproval from a senior manager before trying to deport anyone who is not a recent border crosser, a national security threat or a criminal offender with an aggravated-felony conviction, according to interim enforcement memo issued by the Biden administration Thursday.

The narrower priorities are expected to result in a steep drop in immigration arrests and deportations. Biden officials said the new guidelines — which will be in effect for the next 90 days — will allow the agency to make better use of its resources while prioritizing public safety threats.

Having spent 26 years as an INS (Immigration and Naturalization Service) special agent provides me with a unique perspective that I have provided at numerous congressional hearings and when I provided testimony to the 9/11 Commission.

As I read Biden’s Executive Orders and the various proposals for immigration law changes and massive amnesty programs, I am disheartened and frustrated.  What was the point to the hearings and the 9/11 Commission when the President promulgates policies that not only ignore the 9/11 Commission but actually take America in precisely the opposite direction from where we should be going?

With the stroke of his pen, and without legislation, Biden has profoundly undermined immigration law enforcement.

Hundreds of Illegal Immigrants, Dozens of Unaccompanied Children Apprehended at Border By Catherine Smith

Approximately 200 illegal immigrants including at least 40 unaccompanied minors were apprehended in frigid temperatures in Mission, Texas after being smuggled into the U.S., according to border officials.

The illegal immigrants were accompanied across the border by “human smugglers,” according to Customs and Border Protection (CBP) Rio Grande Valley Chief Patrol Agent Brian Hastings. It was around Wednesday night at 8 p.m. CST when Hastings tweeted about the apprehensions.

“Nobody comes across that river without a smuggler. Nobody just walks up to the bridge and goes across. A smuggler put them in a raft and paddled them across, probably told them to go up to that road, take a left until you walk into an agent,” CBP Public Affairs Officer Rod Kise told the Daily Caller News Foundation.

According to the report, most of the illegal immigrants were likely transferred from CBP into Immigration and Customs Enforcement (ICE) custody, though it is unknown whether the illegal immigrants were deported or released into the interior of the U.S. since that is determined on a case-by-case basis, Kise told the DCNF.

As Border Crisis Worsens, White House Announces New Asylum Processing Program Katie Pavlich

The Biden administration announced a new asylum processing program Tuesday as the illegal immigration crisis on the U.S. southern border continues to get worse. 

Starting February 19, the United States will begin to process eligible individuals in the Migration Protection Protocols (MPP) program to pursue their asylum cases in the US, working closely with the Government of Mexico, as well as international and non-governmental organizations. Individuals should not take any action at this time and should remain where they are to await further instructions. We will soon announce a virtual registration process that will be accessible from any location,” White House National Security Advisor Jake Sullivan and Deputy National Security Advisor Liz Sherwood-Randall released in a joint statement. “Once registered, eligible individuals will be provided additional information about where and when to present themselves.  Individuals should not approach the border until instructed to do so.”

 Two weeks ago, President Biden gutted a series of Trump Administration policies that cut down on asylum fraud.

“We caution people seeking to immigrate to the United States that our borders are not open, and that this is just the first phase in the administration’s work to reopen access to an orderly asylum process. This new process applies to individuals who were returned to Mexico under the MPP program and have cases pending before the Executive Office for Immigration Review,” the statement continues. “Individuals outside of the United States who were not returned to Mexico under MPP or who do not have active immigration court cases will not be considered for participation in this first phase of this program and should await further instructions. If you seek entry into the US and do not have an active MPP case, you will be immediately expelled and will not be permitted to remain in the United States.”
