President Donald Trump is quietly turning a stinging defeat at the Supreme Court over an illegal amnesty for hundreds of thousands of young illegal aliens into what could end up being a victory for the Constitution and the rule of law.

The Supreme Court, of course, has no authority to tell the president of the United States that he cannot rescind an illegal executive amnesty ordered by his predecessor in the same manner it was instituted.

Normally, presidents of both parties rush to raise their arms in surrender whenever the black-robed life-tenured politicians on the high court demand it.

Not Trump.

The president appears to be taking a stand against rampant judicial supremacism by drawing inspiration from President Andrew Jackson, whose portrait proudly hangs in the Oval Office.

After the chief justice of the day overreached in Jackson’s opinion, the 7th president allegedly uttered the following immortal words: “John Marshall has made his decision, now let him enforce it.”

The 2020 census is moving towards its conclusion. A few days ago (July 21) President Trump took the occasion to weigh in with an Executive Order directing the Secretary of Commerce, when he reports the census results to the President, to provide sufficient information to enable the President to exclude from the “apportionment base” reported to Congress any “aliens who are not in a lawful immigration status under the Immigration and Nationality Act.”

Cue the usual outrage on the left. (E.g. from AlterNet.com, “Legal experts slam Trump’s ‘blatantly unconstitutional’ attempt to corrupt the census”; New York Times: “States Sue Trump Over Order to Exclude Undocumented Immigrants From U.S. House Seat Counts.”).

I suspect your reaction might be something different, like: What? Are you telling me that up until now they have been counting illegal aliens in the census for purposes of apportioning representation in Congress? How can that possibly be right? Do illegal aliens get representation in Congress even though they not only cannot vote, but also are not even here legally and are subject to deportation at any time?

President Donald Trump has issued an executive memorandum to Secretary of Commerce Wilbur Ross to discount illegal aliens who are subject to legal removal from the U.S. Census.

Here, the president is invoking the Fourteenth Amendment, Section 2 of the Constitution, which states, “Representatives shall be apportioned among the several states according to their respective numbers, counting the whole number of persons in each state, excluding Indians not taxed.”

From the president’s memorandum: “The Constitution does not specifically define which persons must be included in the apportionment base.  Although the Constitution requires the ‘persons in each State, excluding Indians not taxed,’ to be enumerated in the census, that requirement has never been understood to include in the apportionment base every individual physically present within a State’s boundaries at the time of the census. Instead, the term ‘persons in each State’ has been interpreted to mean that only the ‘inhabitants’ of each State should be included.”

So, who are the inhabitants of each state? The president’s memorandum says it “requires the exercise of judgment.  For example, aliens who are only temporarily in the United States, such as for business or tourism, and certain foreign diplomatic personnel are ‘persons’ who have been excluded from the apportionment base in past censuses.”

Which, raises the question, if tourists — whose travel visas have certain expiration dates — can and have been excluded from the census, then why not illegal immigrants who are subject to removal upon discovery by federal authorities?

I understand that procedural arguments are boring, ineffective, and passe, and that fewer and fewer American are moved by them. But we might want pollsters and media outlets to understand the difference between policy outcomes and constitutional process.

Take a look at this non sequitur:

As with the Supreme Court’s recent re-imagining of Title VII protections, the media are acting as if the recent decision preventing Trump from immediately ending DACA was a referendum on values, empathy, and the intrinsic value of “Dreamers,” rather than on the ability of the president to simply fabricate laws by fiat.

There are a number of persuasive economic and moral arguments for legalizing the children of illegal immigrants. Indeed, as it happens, I support the goals of DACA. But, if they are to become law, they need to . . . well, become law. I also support dropping the corporate income tax to zero. That doesn’t mean I would approve of Donald Trump asking the IRS to stop collecting certain revenue streams by decree.

“Put your own mask on before assisting others.” Flight attendants repeat this wise instruction before every airline flight because, in an emergency situation, an incapacitated passenger cannot help anyone else and, in fact, becomes another person in need. In the current economic and health emergency, Democrats ignore this mandate and instead seek to exploit the crisis as an opportunity to fulfill long-held leftist policy aims like diminishing citizenship and destroying the efficacy of borders. By leveraging a time of pain for so many Americans, these demagogues prove that they put America last.

Two recent actions best showcase this agenda. First, in the mammoth $3 trillion boondoggle that Speaker Nancy Pelosi and House Democrats passed last week, taxpayer handouts of up to $1,200 would flow to illegal migrants. Thankfully, her 1,815-page legislative monstrosity will never become law, but Pelosi’s home state took more immediate action, dispensing tens of millions of California taxpayer dollars to illegal immigrants, with direct cash payments to over 100,000 trespassers.

The appalling disconnect between these leftist politicians and the current angst among America’s citizenry underscores the distorted reality of an entitled political class operating in a sort of parallel universe, undeterred by the on-the-ground predicament of millions of Americans. Consider that 36 million people are newly jobless. Even among the still-employed, job anxiety is pervasive: A recent Associated Press poll showed that 55% of working Americans report a cut in either hours or pay during this pandemic.

The message of Democrats like Pelosi and Gov. Gavin Newsom to these worried Americans is clear: “Get in line, because we have other priorities, including catering to the needs of criminals who willfully violated our laws to enter the United States without permission.” Presumptive Democratic presidential nominee Joe Biden clearly agrees with this policy arc, as he publicly affirmed during his party’s primaries that he supports providing taxpayer-funded health care to illegal aliens.

“Justice Ruth Bader Ginsburg, a liberal stalwart of the bench, wrote the high court’s opinion.“[T]he appeals panel departed so drastically from the principle of party presentation as to constitute an abuse of discretion,” Ginsburg wrote, and later stated that “a court is not hidebound by the precise arguments of counsel, but the Ninth Circuit’s radical transformation of this case goes well beyond the pale.”

The Supreme Court unanimously upheld a federal statute that forbids encouraging illegal aliens to remain in the U.S. unlawfully in a decision Thursday.

The Supreme Court justices voided an earlier decision by the Ninth Circuit Court of Appeals, which had ruled that a federal anti-harboring statute was unconstitutional on the grounds that it violated the First Amendment by restricting free speech. The ruling by the nation’s highest court Thursday upholds the law.

The Supreme Court not only vacated the appeals court’s decision, but also criticized the judges for “drastically” straying from judicial norms.

Justice Ruth Bader Ginsburg, a liberal stalwart of the bench, wrote the high court’s opinion.

“[T]he appeals panel departed so drastically from the principle of party presentation as to constitute an abuse of discretion,” Ginsburg wrote, and later stated that “a court is not hidebound by the precise arguments of counsel, but the Ninth Circuit’s radical transformation of this case goes well beyond the pale.”

The decision brings to a close a court battle that lasted roughly 10 years.

With all of the focus on the Coronavirus pandemic other major issues. such as the immigration crisis, is being utterly ignored by the news media.

There is however, a direct nexus between failures of the immigration system and the current Coronavirus Pandemic.  China has robbed America blind of intellectual property that has included high tech research into biology, chemistry and physics. 

Indeed, Chinese espionage has become so routine across a wide array of areas including military secrets that the intelligence community has given it the sarcastic nickname of “Chinese Takeout!”

Obviously, in order to spy on America, Chinese operatives need to enter the United States.

Border security involves much more than our northern and southern borders, it also includes the vetting process conducted at ports of entry by CBP (Customs and Border Protection) inspectors and the issuance of visas at U.S. embassies and consulates overseas.

Cali Dems Double Down Weaponizing a pandemic to crack down on Americans and hand out cash to illegals. Lloyd Billingsley

“The rapidly expanding COVID-19 pandemic threatens the lives and livelihoods of Californians,” notes veteran journalist Dan Walters of CalMatters, “but it also lays bare some multi-billion-dollar shortcomings in state government finances that have been ignored for decades, despite many warnings.”  The state’s $20 billion “rainy day fund,” for example, will soon be depleted and the state forced to borrow money to remain afloat.

Californians have lost jobs in six of the state’s industry sectors, with more than 500,000 job losses in the first three weeks of March. Unemployment may soon exceed 12.5 percent, worse than during the Great Recession.

“Until further notice,” Edward Ring of the California Globe explains, “California’s economy is in free fall.” Those realities have yet to register with Gov. Gavin Newsom (pictured above), who is handing out $125 million to foreign nationals illegally present in the United States. The illegals will get checks for $500 with a cap of $1,000 per household. As CNN notes, these are people “who’ve broken the law,” but there’s more to it.

People illegally present in the United States use false documents, so the governor and state officials have no idea who is getting the $125 million. It is certain that the false-documented recipients are foreign nationals, so the governor is giving away money with zero compensation from the illegals’ own governments, primarily Mexico. The same applies to the costs of educating and incarcerating the false-documented, and paying for the illegals’ health care.

Mexican Drug Tunnel Exits in U.S. Warehouse Run by Illegal Aliens Near CBP Crossing

Mexican drug smugglers are really getting bold. A cross-border tunnel recently discovered by U.S. authorities exits in a San Diego warehouse right next to a busy Customs and Border Protection (CBP) port of entry. It gets better. The southern California warehouse is manned by Illegal immigrants even though it is situated just a few hundred yards from a hectic border crossing staffed with federal agents around the clock.

A Mexican national with legal residency has been arrested and charged in connection to the operation, federal prosecutors announced this month. His name is Rogelio Flores Guzman and he helped construct the tunnel, which runs 2,000 feet from a Tijuana warehouse to the south San Diego depot. The U.S. has charged the 31-year-old with trafficking fentanyl, methamphetamine, heroin, cocaine and marijuana via a subterranean tunnel stretching from Mexico to a warehouse in Otay Mesa. When authorities entered the tunnel, they found around 575 packages of drugs worth nearly $30 million, according to a bulletin issued by the Department of Justice (DOJ). This sets a record because it marks the first time that five different types of drugs are found in a tunnel, according to the feds.

Agents from a special tunnel task force confiscated 394 packages containing 585 kilograms of cocaine; 133 packages containing 1,355 kilograms of marijuana; 40 packages containing 39.12 kilograms of methamphetamine; Seven packages containing 7.74 kilograms of heroin and one package containing 1.1 kilograms of fentanyl. “Cross-border tunnels always spark fascination, but in reality they are a very dangerous means for major drug dealers to move large quantities of narcotics with impunity until we intervene,” said the federal prosecutor in charge of the case, U.S. Attorney Robert Brewer. “We have seized this tunnel, confiscated almost $30 million in drugs and now we’ve charged one of the alleged crew members.”

We Still Are Not Controlling the Borders By Kevin D. Williamson

Another American murdered by an illegal immigrant, despite Trump’s promises to end this kind of crime.

D onald Trump rose to political power waving the bloody shirt of Kate Steinle, who was shot and killed by an illegal immigrant from Mexico, one who already had been convicted of a raft of felonies and deported five times. Donald Trump promised he would put a stop to that.

He hasn’t.

The outrage over Steinle’s death was understandable — and, worse, the man who killed her, José Inez García Zárate, was acquitted of murder and manslaughter charges and, incredibly enough, even (on appeal) of the charge of being a felon in possession of a firearm, though he indisputably 1) is a felon, and 2) was in possession of a gun at the time he shot it and killed Kathryn Steinle. Expect to hear a good deal less about the death of 16-year-old Franklin Mercado, who was stabbed to death in what police believe was a gang retaliation and dumped in a park in Dallas.

Among those charged in his death is 25-year-old Jonathan Alexander Gonzalez-Rosales, a gangster from El Salvador, a member of something the U.S. government designates a “transnational criminal organization,” illegally present in the United States, known to law enforcement, and under a removal order.

See if you can spot the weak link: In 2017, Gonzalez-Rosales appeared in a San Antonio court on unrelated charges and came to the attention of ICE’s Enforcement and Removal Operations (ERO). They filed an “immigration detainer” and issued him a notice to appear. He was released from ICE custody in February 2018 after posting bond, and his hearing was set for July. Of course, he did not show up for his hearing. Of course, the authorities lost track of him. Of course, nothing was done until he had murdered a 16-year-old.

He was picked up Tuesday in Dallas on the murder warrant. He’ll be in ICE custody until he is turned over to Dallas. In theory, he will be deported after the murder case is resolved.
