U.S. Supreme Court lets Trump use disputed funds for border wall

The U.S. Supreme Court on Friday handed President Donald Trump a victory by letting his administration redirect $2.5 billion in money approved by Congress for the Pentagon to help build his promised wall along the U.S.-Mexico border even though lawmakers refused to provide funding.

The conservative-majority court on a 5-4 vote with the court’s liberals in dissent blocked in full a ruling by a federal judge in California barring the Republican president from spending the money on the basis that Congress did not specifically authorize the funds to be spent on the wall project fiercely opposed by Democrats and Mexico’s government.

“Wow! Big VICTORY on the Wall. The United States Supreme Court overturns lower court injunction, allows Southern Border Wall to proceed. Big WIN for Border Security and the Rule of Law!” Trump tweeted just minutes after the court acted.

A brief order explaining the court’s decision said the government “made a sufficient showing” that the groups challenging the decision did not have grounds to bring a lawsuit.

In a highly unusual move, Trump on Feb. 15 declared a national emergency in a bid to fund the wall without congressional approval, an action Democrats said exceeded his powers under the U.S. Constitution and usurped the authority of Congress.

Frequently Americans who understand the true significance of our immigration laws and need for secure borders lament that the Left appeals to the emotions of Americans.  The emotion that is most often cited is that of compassion.

Americans are among the most kind-hearted and generous people on earth.  Therefore appeals to compassion can be very effective.

Frequently we make decisions either based on emotions or reason.  Generally emotional decisions ignore cold, hard facts.

Consequently the Radical Left, the media and globalist immigration anarchists have weaponized compassion using our best intentions against us, always portraying illegal aliens in the most sympathetic ways possible.  While many illegal aliens are simply desperate people who want to flee the grinding poverty of their home countries to come to the United States for a better life.  However the United States does not have infinite resources.

We need to compare the United States to an overcrowded lifeboat that is tossed in a storm with many other people thrashing about in the cold water.  The problem is that if we permit those in the water onto the lifeboat, it will capsize.

Simply stated, uncontrolled immigration is an invasion that will quickly overwhelm our nation’s economy and infrastructure.  Overcrowding our schools has a deleterious impact on the education our children receive.  Flooding America with millions of additional aliens impacts the price and available of housing, driving up prices while the massive influx of competing foreign workers frequently displaces Americans and drives down wages.  This causes massive increases in homelessness across the United States.

India’s 2,582 mile border with Bangladesh is even longer than America’s 1,954 mile border with Mexico.

The two countries are divided not only by that border, but by religion. India has an 80% Hindu majority and a rising 13% Muslim minority. Bangladesh has a 90% Muslim majority. And the tide of Muslim migration from Bangladesh to India began to shift the population balance in some Indian states.

India has spent decades building fences, topping them with barbed wire, and installing lights. The lights are there so that the guards can see. Unlike America, there are guards, they have guns, and they shoot.

What makes America’s border different from those of so many other countries isn’t the lack of fencing. Smugglers, traffickers, and assorted criminals can often find weak points in any security setup. In most countries, the defense of the border is seen as a national security issue backed by real firepower.

America’s Border Patrol has less than 20,000 people. India’s Border Security Force has 186 battalions and 257,363 people. It’s a paramilitary organization with an intelligence network, ten artillery units, air and marine wings, and canine and even camel units. And the weapons aren’t just there for show.

Over 1,000 illegal infiltrators have been killed trying to enter India from Bangladesh in over a decade.

BSF personnel are allowed to shoot on sight. Boats are used to monitor river areas that can’t be fenced in. Air units watch from the sky. And intelligence units gather information on smuggling gangs. The first and final line of defense though comes from men with rifles watching the fences and the shadows.

When a Bangladeshi teenage girl illegally entering India was shot, leftist activists hoped to use her to stop the zero-tolerance border security policy. But India kept building fences and defending them.

Gentle readers, things have reached a pretty pass in Los Angeles, where, sad to say, the two most influential political constituencies are now the homeless and illegal immigrants. Everyone else, all you citizens and legal immigrants, all you people paying your mortgages or your rent, and most important all you people paying your taxes and keeping the racket running, you’re the marks, and you’re expected to keep paying and be quiet about it.

We’ll leave the homeless aside for our purposes today, turning our attention to illegal immigrants and the inordinate sway they hold over L.A.’s politicians. And in speaking of politicians, I include Los Angeles Police Department Chief Michel Moore, who in a display of spineless dishonesty rivaled only by that of the mayor himself, appeared last week alongside Mayor Eric Garcetti to produce a video intended to allay the fears of illegal immigrants facing deportation.

“We’ve all heard reports,” Garcetti says to open the video, “that the Trump administration is threatening to round up and deport thousands of immigrant families this weekend.”

Thus, the mendacity begins with the very first sentence. The deportations, says Garcetti, are to be carried out by the “Trump administration” rather than an agency of the federal government fulfilling its duty under the law. And note the resort to an old and tired deception, the reference to “immigrant families,” eliding the distinction between legal and illegal immigrants.

Garcetti goes on to encourage “every Angeleno to know their rights and how to exercise them.” After reminding his audience they have the right to remain silent, he says, “You don’t have to open your door to an ICE agent who doesn’t have a warrant signed by a judge.” No, Mr. Mayor, we wouldn’t want anyone traipsing onto the premises without permission, would we?

And then comes the part taxpaying rubes will find most galling. “And if you need help finding an attorney,” says Garcetti, “you can call 311and learn more about our Justice Fund and other resources that offer legal support.” The city’s 311 system is intended to be a resource for Los Angeles residents seeking routine services like pothole repair and trash cleanup. In my experience as both a resident and employee of the city, such requests take months to receive attention, if indeed they receive any at all. You can dial 311 until your finger bleeds as you watch the trash pile or homeless encampment multiply outside your door, but if you call to tell them you’re on the run from ICE agents, you’ll get help muy pronto. It has been my contention, for many years, that contrary to the lies spewed in the mainstream media that the immigration system is broken while, in reality, the immigration system is not broken, but has become the most efficient delivery system in the United States rivaling Fed-Ex and UPS combined.

What the immigration system delivers is a virtually unlimited supply of cheap and exploitable labor, an unlimited supply of foreign tourists, of foreign students and, for the immigration lawyers, an unlimited supply of clients for immigration law firms.

This was the underlying premise to my article, Sanctuary Country – Immigration failures by design.

This past month, most of the coverage about the Congress focused on the war of words between President Trump and the Democrats, particularly the venomous and frequently Anti-Semitic statements spewed by “The Squad” that consists of four first-term female members of Congress, Alexandria Ocasio-Cortez of New York, Ilhan Omar of Minnesota, Ayanna Pressley of Massachusetts and Rashida Tlaib of Michigan.

A virtual mantra has been created that the reason we have an immigration crisis is because the Democrats will not work with the Republicans (or visa versa).

You would think that if there was any movement to create immigration legislation that the media would jump all over it and put the story on page one in the newspapers and the “A Block” on television programs.  After all, the mythology goes, the Democrats and Republicans have steadfastly taken diametrically opposed positions on immigration.

“The victim was dismembered, and his body parts were thrown into a canyon after one of the defendants allegedly cut the heart out of the victim’s body.”

That is from a July 16 statement from the U.S. Attorney in Central California, announcing charges against “22 people linked to the MS-13 transnational gang, most of whom allegedly participated in a series of murders, including several slayings in which victims were hacked to death with machetes in the Angeles National Forest.”

U.S. Attorney spokesman Thom Mrozek told reporters that 19 of the 22 gang members were illegally present in the United States. Four of the killings took place in Angeles National Forest and the gang members used machetes, bats and knives on the victims. As U.S. officials explained, new MS-13 members are required to murder a rival or enemy of the group. In one case, a member of a rival gang who defaced MS-13 graffiti had his heart cut out of his chest.

The charges against the 22 MS-13 members prompted no statement from California governor Gavin Newsom, whose first trip as governor outside the state was to El Salvador. As he said, the trip was to “counter Trump,” who often speaks out against illegal immigration in general and MS-13 in particular. State attorney general Xavier Becerra, once on Hillary Clinton’s short list as a running mate, was also silent after the MS-13 bust, hardly the only such action in recent times.

In Mendota, according to a Fresno Bee story by Yesenia Amaro, “MS-13 carved out a reign of terror resulting in at least 14 brutal murders in and around Mendota from 2015 to 2017.”

Americans’ steadfast adherence to the rule of law separates the United States from almost every other country, even other free societies. There is nothing more contrary to the rule of law, however, than the current lack of control over our southern border, across which thousands now pass illegally every day.

Alexis de Tocqueville, the young French diplomat who toured America extensively in 1831 then wrote De la démocratie en Amerique, the most celebrated portrait of the young nation’s society, marveled at the operation of the rule of law here.

He wrote that “in America one man never obeys another man, only justice or the law.” And Tocqueville observed: “I doubt whether crime evades punishment less often in any other country … During my stay in the United States, I saw the inhabitants of a county where a major crime has been perpetrated spontaneously form committees with the aim of arresting the guilty man and handing him over to the courts.”

That spirit is why the Immigration and Customs Enforcement raids that began days ago against thousands of illegal aliens who have been served final deportation orders from the courts are a political loser for the Democrats so convinced of the opposite.

Sen. Elizabeth Warren of Massachusetts, rising in the polls in her quest for the Democratic presidential nomination, last week unveiled “a sweeping plan to change the country’s immigration system” and decriminalize illegal immigration, while giving away $1.5 billion “to fund programs targeting crime, poverty, sexual violence, and trafficking in Central America” – the operative principle being that if you can’t end a crisis, normalize it.

Many people benefit from the lawbreaking: The Mexican and Central American governments, the Democratic party, employers, ethnic activists, rich progressives, and the illegal border crossers themselves.

Almost every party invested in open borders proves utterly selfish, without regard for the legitimate interests of others or of the law itself.

The Illegal Immigrant
The immigrant is the pawn of Latin American governments who view him as inanimate capital, someone who represents thousands of dollars in future foreign-exchange remittances, as well as one less mouth to feed at home — if he crosses the border, legality be damned. If that sounds a cruel or cynical appraisal, then why would the Mexican government in 2005 print a comic booklet (“Guide for the Mexican Migrant”) with instructions to its citizens on how best to cross into the United States — urging them to break American law and assuming that they could not read?

Yet for all the savagery dealt out to the immigrant — the callousness of his government, the shakedowns of the coyotes and cartels, the exploitation of his labor by new American employers — the immigrant himself is not entirely innocent. He knows — or does not care to know — that by entering the U.S., he has taken a slot from a would-be legal immigrant, one, unlike himself, who played by the rules and waited years in line for his chance to become an American.

He knowingly violates U.S. immigration law. And when the first act of an immigrant is to enter the U.S. illegally, the second to reside there unlawfully, and the third so often to adopt false identities, he undermines American law on the expectation that he will receive exemptions not accorded to U.S. citizens, much less to other legal immigrants. In terms of violations of federal law, and crimes such as hit-and-run accidents and identity theft, the illegal immigrant is overrepresented in the criminal-justice system, and indeed in federal penitentiaries.

Graham Outlines the Abuse of Children Being ‘Rented’ to Help Migrants Claim Asylum: ‘This Is a Sick System’ Houston Keene

Chairman of the Senate Judiciary Committee Lindsey Graham (R-S.C.) explained how migrant children are being “rented” to help other migrants claim asylum when attempting to cross into the U.S. over the southern border.

During an interview with Fox News’ “Sunday Morning Futures,” host Maria Bartiromo pressed Graham on the claim that migrants have been “renting” their children so that others can claim asylum in the U.S. and his claim that 30% of families apprehended while attempting to cross the U.S.-Mexico border are not really related.

Graham responded by saying that officials at the border have started a “pilot program” where they are testing the DNA of migrant family units at the border and that he was told of “about 60 children” who were being “recycled” at the border to allow more people to claim asylum.

“They told us about 60 children that were recycled,” said Graham. “They pick the child up in Central America, they bring them to the United States, everybody’s released, and the child goes back to Central America to do it again.”

The Senate Judiciary chairman continued on to call the system that has “exploited” children “sick” and “rotten to its core.” He also brought up that “100,000 unaccompanied minors” had been apprehended at the southern border “this year alone.”

Acting Customs and Border Patrol Commissioner Mark Morgan told Republican senators last month that migrants were renting children to allow for easier passage into the U.S. through the southern border.

Iowa Senator Chuck Grassley (R-Iowa) said that he could not “believe” that people were “renting babies” to enter the country.

“I can’t believe that this actually happens but that people down there in Central America or Mexico are renting babies to get across the border and then sending them back and renting them again to get across the border,” said Grassley.

What is going on in this country right now, especially on Capitol Hill, is nothing short of deceitful behavior which intentionally distorts the truth in order to win a political battle.

I saw it firsthand when I testified on Capitol Hill this past Friday, in front of the House Committee on Oversight and Reform.  Aside from the six minutes I was given to read my opening statement, there was an attempt by most  Democrats on that committee to silence me.

The issues surrounding zero tolerance and the conditions of confinement at Border Patrol stations is an important one and it is vital that the American people know the facts. But every time one of the witnesses or members of Congress said something that was downright wrong – a lie, an intentional mis-truth – and I attempted to speak up and correct the record, I was refused many times the opportunity to speak.

They didn’t want to hear from me. They didn’t want the truth. They simply wanted to continue to push their false narrative about the Border Patrol and ICE.  They wanted to continually attack our president.

The hearing was nothing but political theater to misinform the American people. It was politics at its worse.

Toward the second half of the hearing, I finally decided that I was not going to be silenced any longer. If they didn’t want to hear what I had to say, then I was going to interject, interrupt and speak to the American people.  I refuse to be bullied, and I will not be silenced in my support of the Border Patrol and ICE or in support of the truth.
