When you knowingly cross the border into another country — any country — without permission, that’s a crime, right? Yes, in every country in the world.

Some aspiring Democratic candidates in Texas want to change that. They think we should decriminalize unlawful border crossings.

Others on the left want to go even further. They would essentially gut the power of the Immigration and Customs Enforcement agency (ICE).

Three candidates running for office in Texas have floated a scheme to remove the power of ICE without actually getting rid of the agency, which has been what protesters and even members of Congress have been advocating over the past several months. This includes Representative Beto O’Rourke (D., Texas), who is running for the U.S. Senate; Lupe Valdez, who is running for governor; and Democratic congressional candidate Veronica Escobar.

Most people would say that this scheme is reckless and irresponsible — one that, if enacted, would endanger public safety. And the latest report from the Texas Department of Public Safety (DPS) shows why. Perhaps these candidates should read that report. Certainly, the residents of the Lone Star State should, as they are the ones who have been the victims of crimes by illegal aliens — crimes such as murder, rape, assault, robbery, and the like.

On July 13, 2018, Mollie Tibbetts was murdered when she went jogging in her hometown of Brooklyn, Iowa. Her alleged killer, Cristhian Bahena Rivera, is an illegal alien from Mexico.

Many articles and commentaries have detailed this horrific crime.

But my goal today, in addressing the murder of Mollie Tibbetts, is to provide insight into the lessons that must be learned, from my perspective, as an experienced, 30-year veteran of the INS (Immigration and Naturalization Service).

For starters, immigration anarchists on the left decry any mention of the fact that Rivera is an illegal alien because, they claim, that doing so is an attack on all “immigrants.”

But these immoral leftists could not care less about the real carnage created by systematic failures of the current immigration system. To them, the bodies of those who are killed by illegal aliens are simply “Speed Bumps” on their road to a borderless and defenseless United States.

Let’s be crystal clear: Rivera is many things. I could use all sorts of terms to describe him and his horrific, infuriating murder of a 20-year-old young woman he, allegedly, committed for no damned reason. However, one name that most certainly does not apply to him is “immigrant.”

The day before we left to take our oldest child to college for the first time, police found the body of Mollie Tibbetts. The news about the 20-year-old college student who went missing while on an evening jog in July had made me nervous for the past month. It was hard to read coverage of Mollie’s disappearance without getting a pit in my stomach about sending my daughter away to school. We talked about how to stay safe, the buddy system, the influence of alcohol, carrying mace, and every other base I could cover.

As my daughter and I were scrambling to finish last-minute tasks before heading out to Syracuse, news alerts shared the devastating news: The petite, pretty girl from Iowa was dead. Hours later, more infuriating details followed: Mollie was hunted down, murdered, stuffed into a car trunk and dumped in a cornfield by a monster who shouldn’t be this country. (There are no charges against Cristhian Rivera for sexual assault as yet.)

I was outraged, heartsick, and scared. My daughter also was afraid; I again warned her that evil is everywhere. And I fumed that our government fails repeatedly to keep our children safe from people who are in our country illegally.

The role of immigration policy failures

How responsible is immigration policy for Mollie Tibbetts’s murder?

The chief culprit, obviously, is the murderer himself, Mexican illegal alien Cristhian Rivera (if that’s even his real name). But immigration control is one of the elemental responsibilities of the national government, and it failed in this case. As Senator Tom Cotton put it: “Mollie would be alive if our government had taken immigration enforcement seriously years ago.”

But there are different levels of culpability. The government bears the greatest share of blame when the authorities have an illegal alien in custody, they know he’s deportable, they release him anyway, and he goes on to commit more crimes. For example, it’s not too much to say that the elected and appointed officials of San Francisco were accomplices in the deaths of Kate Steinle and the Bologna family because of that city’s sanctuary policies.

The least share of responsibility would accrue to our immigration policies if an alien managed to infiltrate the country undetected and then had no interactions with government or any other institutions of our society before committing his crime. Given how unserious we are about immigration enforcement, our policies would still warrant a share of the blame, but the responsibility would be more diffuse and indirect.

The Tibbetts murder falls somewhere in between. Unlike the killers of Steinle, the Bolognas, Menachem Stark, Jamiel Shaw II, Drew Rosenberg, Grant Ronnebeck, Reginald Destin, and others, Tibbetts’s killer was not shielded by a sanctuary jurisdiction and is not believed to have been previously arrested and released (though we may learn more in the coming days).

I live on farm beside a rural avenue in central California, the fifth generation to reside in the same house. And after years of thefts, home break-ins, and dangerous encounters, I have concluded that it is no longer safe to live where I was born. I stay for a while longer because I am sixty-five years old and either too old to move or too worried about selling the final family parcel of what was homesteaded in the 1870s.

Rural Fresno County used to be one of the most ethnically diverse areas in the United States. I grew up with first-, second-, and third-generation farmers—agrarians of Armenian, German, Greek, Mexican, Japanese, Portuguese, Punjabi, and Scandinavian descent.

Race and ethnicity were richly diverse; yet assimilation was the collective shared goal—made easier because immigration was almost entirely a legal and measured enterprise. No one much carried for the superficial appearance of his neighbors. My own Swedish-American family has intermarried with those of Mexican heritage. My neighbor’s grandchildren are part white, Japanese, and Mexican. The creed growing up was that tribal affiliation was incidental, not essential, to character.

Family farming was never an easy enterprise. But an us/them mentality prevailed that united diverse farmers against both human and nature’s challenges. Yet most of those rural families now have all moved away or passed on. Their farms are leased to corporate enterprises and their homes rented to mostly immigrants from Mexico—many of them undocumented. Globalized agribusiness and unchecked illegal immigration, in different ways, combined to change central California and has made living in rural areas no longer safe.

This column has been hoping for some time that Washington lawmakers will cut a deal that allows more immigration and forgiving treatment for those brought here as children in return for the construction of President Donald Trump’s promised border wall and enhanced law enforcement. This week was a reminder of just how difficult it may be to forge such a compromise.

Not at all helpful was Sen. Elizabeth Warren (D., Mass.) in a Wednesday morning interview with CNN’s John Berman. Here’s a partial transcript:

Mr. Berman: … a very important story in the news: it has to do with Mollie Tibbetts, the young woman in Iowa who was murdered, her body believed to be found yesterday. A person has been charged with it. This person is an undocumented immigrant. Mike Pence and the president have suggested the immigration laws need to be stronger so that people like this man who was accused of this murder were not in the country. Your reaction?

Sen. Warren: I’m so sorry for the family here and I know this is hard not only for the family but for the people in her community, the people throughout Iowa. But one of the things we have to remember is we need an immigration system that is effective, that focuses on where real problems are.

Once again, immigration fraud has compromised U.S. national security. Fortunately, this time, the discovery was made before a deadly terror attack.

The issue of immigration fraud was the focus of both an extensive article and a booklet I wrote on the topic, Immigration Fraud, Lies That Kill.

This time an alien couple stands accused of fraud when they entered the United States as refugees, and then applied for legal immigrant status, but they hid their ties to Al-Shabab, an Islamic militant group operating primarily in Somalia who itself has links to al-Qaeda.

The case we will examine today, less than one month before the 17th anniversary of the terror attacks of 9/11, was brought to fruition by the Joint Terrorism Task Force (JTTF) as a result of the diligent work of the FBI and a division of ICE known as HSI (Homeland Security Investigations).

In July, as the left chanted “Abolish ICE,” calling for the end of immigration enforcement, a Mexican illegal abolished Mollie Tibbetts. The two stories came together in August as Cristhian Bahena Rivera led law enforcement to the body of the 20-year-old college student that he had buried in a cornfield.

On the same day that Mollie was murdered, the House voted on a resolution supporting the Immigration and Customs Enforcement agency (ICE) for fighting to keep Americans safe.

34 Democrats and one “Republican,” Rep. Justin Amash, an anti-Trump fanatic who votes with the Dems where it counts, voted against ICE and immigration enforcement. 133 Democrats voted “Present,” including Pelosi and Hoyer. Only 18 Democrats voted in support of H.Res. 990.

Rep. Steny Hoyer, the Dem Minority Whip, called support for ICE a “sham and a distraction” from the more important issue of “the safety of those who come here seeking asylum.”

But there was no asylum for Mollie and other American women from the illegal migrant murderers.

Senator Elizabeth Warren, one of the first to call for abolishing ICE and replacing it with a pro-illegal organization, responded to Mollie’s murder by gazing blankly at the camera, and saying, “I know this is hard” for her family and people in Iowa, but that the “real problems” lie in the suffering of illegal aliens.

This is not the Mollie Tibbets story. But it does show the ubiquity of illegal alien crime. Especially the murder of women.

On Tuesday evening, U.S. Immigration and Customs Enforcement announced it placed an immigration detainer with the Scott County Jail on Fraider Diaz-Carbajal, “an illegal alien from Mexico, for suspected immigration violations following his local arrest for second-degree murder.”

According to ICE, Diaz-Carbajal has a criminal history that includes “numerous misdemeanor convictions, including three DUIs and one for domestic assault. On Dec. 17, 2012, a federal immigration judge ordered Diaz-Carbajal removed (deported) to Mexico; ICE officers removed him two days later. Since then he illegally re-entered the United States, which is a felony. He remains in local custody pending adjudication of his criminal charges.”

Fraider Diaz-Carbajal is charged with second-degree murder in the death of 27-year-old Enedelia Perez Garcia.

Shortly after 4 p.m. on Aug. 12, officers were called to an apartment on the 1200 block of Taylor Street on a report of an assault. According to the criminal complaint, when officers arrived, they found Diaz-Carbajal lying face down on top of the victim. The victim was sitting on the floor with her back against the wall and did not appear to be breathing. The suspect was laying on her with his head resting on her stomach and chest. Officers observed a lot of blood around the pair and in the area, as well as a large knife covered in blood next to the suspect.

Democratic Sen. Elizabeth Warren said Wednesday she’s “sorry” Mollie Tibbetts is dead, but urged her family and friends to remember to focus on the “real problems” at the border, where parents are being temporarily separated from their children.

An illegal immigrant has been charged with murdering Tibbetts, a 20-year-old University of Iowa student recently found dead in a cornfield. Republicans have called for a stronger immigration system that might have prevented this crime.

After offering her condolences to the Tibbetts family, who will never be reunited with their daughter again, Warren immediately pivoted to how said it is that moms at the border who have willfully broken the law are being temporarily separated from their babies.

“I’m so sorry for the family here and I know this is hard not only for her family but for the people in her community, the people throughout Iowa,” she said. “But one of the things we have to remember is we need an immigration system that is effective, that focuses on where the real problems are.”
