It’s 2:55 a.m. and I just figured out how Pence massaged the rules of the Electoral College counting session to avoid introducing the “rival” slates of Trump electors.

These are the instructions VPs have given out at the start in each of the last 5. Note the difference?

TLDR: The law specifies that the VP must introduce all “purported” electoral votes. This year, that might’ve included the unserious/mock Trump electors.

But Pence worked with the parliamentarian to interpret it so only electors backed by a state “authority” would be introduced.

Let’s pause here, both to expand upon this stupendous news (Cheney’s snarky editorializing aside) and let it sink in because I am sure this will be brand new to most readers.

True story. Yesterday, as stories disparaging Sidney Powell’s motion to dismiss Dominion’s $1.3 billion defamation lawsuit began mounting up, all of them seizing on a few words from her lawyers’ brief to the  point that “no reasonable person” would conclude that her publicly discussed findings against Dominion were “statements of fact,” I knew something was wrong with this narrative, obviously. The idea that Sidney Powell would put forward a Dumb Blonde argument to discredit herself in defense of herself was and is ludicrous.

I wasted a few minutes yesterday looking for a piece of journalism that colored outside these crudely drawn party lines and found not a one. Not a one! No surprise but the absence of basic expository journalism clarifies one of the crises we face as a post-democratic society. There is no functioning Fourth Estate, there are only propaganda organs of the regime.

I read most of the 90-page brief myself, which is here, and got my own news. No, Sidney Powell did not say she was just making stuff up. Mouthpiece Media spatchcocked a couple of phrases together and lied about them. 

By the way, as Lin Wood pointed out on his Telegram account, “Dominion’s lawyer, Tom Clare, also represents Bill Gates. Just sayin’.”

For anyone who doubts that we are living through Obama 2.0, the mass-murder attack at the King Soopers grocery store in Boulder, Colo., should be an eye-opener.

A young Muslim male immigrant from Syria carries out an ostensibly senseless shooting spree, killing ten innocent people in cold blood. A full day goes by without his being publicly identified, even though the authorities had him in custody, had identified him, and were searching his home and interviewing family members. Based on past experience with such delays, sensible people begin to wonder if there’s an effort to spin the story in a certain way so that the benighted American public won’t leap to conclusions based on negative stereotypes of Muslims.

Finally, he is identified as a 21-year-old Muslim man named Ahmad Alissa — the media sticking to a less obviously Islamic rendering of his name than “Al Issa,” which is how the suspect refers to himself. (Isa is Arabic for Jesus, whom Islam regards as a prophet.)

And now, inevitably, the Will we ever know the motive? narrative has commenced, with the New York Times, as ever, leading the way.

President Joe Biden on Wednesday appointed Vice President Kamala Harris to lead the White House’s efforts to combat the worsening crisis at the U.S.-Mexico border where governmental resources have been stretched thin by a surge of migrants entering the country.

Harris will work with Mexico, El Salvador, Guatemala, and Honduras in an attempt to slow the influx of asylum seekers. U.S. Customs and Border Protection has said its agents encountered 100,000 migrants making illegal crossings in February, a 28 percent increase from the month before.

“I can think of nobody who is better qualified to do this,” Biden said, noting Harris’s prior work as California attorney general.

“When she speaks, she speaks for me, doesn’t have to check with me,” the president added. “She knows what she’s doing and I hope we can move this along.”

Biden, however, shirked responsibility for the situation at the border, saying the surge “started in the past administration but it is our responsibility” to handle it.

Hundreds of Migrant Children Test Positive for Coronavirus Upon Arrival at HHS Facilities By Zachary Evans

Around 2,900 migrant children detained by U.S. Border Patrol over the past year tested positive for coronavirus, including 300 currently in custody of U.S. agencies.

There are currently over 11,500 unaccompanied minors in shelters run by the Department of Health and Human Services, according to government data obtained by Axios. The 300 positive cases make up less than 3 percent of all migrant children in HHS custody, and are reportedly in medical isolation in HHS facilities.

“The positivity rate in general is what was anticipated, and planning has resulted in robust response,” HHS spokesman Mark Weber told Axios on Wednesday.

The influx of migrant children crossing the southern border has caused a backlog in HHS, which is charged with finding shelter for the children while their asylum claims are processed. Border Patrol agents are charged with finding HHS shelters for unaccompanied minors following their detention, however because of the backlog many children have remained in border patrol facilities longer than the 72-hour legal limit.

The Biden administration  forbid media outlets from visiting or receiving photographs from inside Border Patrol facilities, however Representative Henry Cuellar (D., Texas) provided Axios with images from one such facility showing overcrowded conditions.

“We have to stop kids and families from making the dangerous trek across Mexico to come to the United States,” Cuellar said. “We have to work with Mexico and Central American countries to have them apply for asylum in their countries.”

The 11,500 migrant children currently HHS custody is higher than the number of children detained in May 2019, when a major uptick in illegal crossings overwhelmed border agencies.

New York City’s gifted and talented students are in the crosshairs of woke activists who seek to impose “racial justice” in the city’s school system, not by improving education but by destroying opportunities for the city’s most advanced learners. And we can’t let them win.

A consortium of activists, including celebrity lawyer Ben Crump, has filed an 81-page lawsuit against the State of New York, New York Governor Andrew Cuomo, New York City Mayor Bill De Blasio, and other state and city education officials, demanding the elimination of merit-based admissions to the city’s Gifted and Talented programs. The lawsuit argues the city’s gifted program and its specialized schools, including Stuyvesant High School and the Bronx High School of Science, perpetuate an illegal “racial hierarchy,” “racism,” and “segregation” because black and Hispanic students qualify for them at a lower rate than white and Asian students.

The proposed remedy – eliminating gifted and talent programs and schools and punishing smart kids – will not fix the systemic academic problems in New York City elementary and middle schools that are the root cause for this “racial hierarchy.” Instead, it will promote another discrimination: against advanced learners. The legal activists demand discrimination against students whose academic performance ranks in the top 1.5 percent of their peers, and they disparage these students as having “in-the-know” parents. It is common sense that we will accomplish nothing as a society and surely do much harm if we embrace a conception of “fairness” that involves attacking and delegitimizing excellence as a form of “racism.”

That’s why a new organization, Parents Defending Education, filed a motion today to intervene on behalf of New York City parents whose children attend gifted and talented schools.

Attacks on gifted education programs have been a front in the national culture war that has heated up over the past year. “Social justice” advocates promote a concept of “equity” that any deviation in racial outcomes – such as gifted enrollments – can only be explained by racism. From New York to Seattle, these activists are working to dilute the most advanced and rigorous coursework with concepts from the ideology of critical race theory, including curriculum infused with discussions on “white privilege,” “systemic racism,” “structural inequity,” and “white supremacy.”

“It is hard to come away with any conclusion other than that de Blasio’s endless blather about income inequality was just a sick joke. He had no idea how income inequality had originated, and no idea how to diminish it. What he has done in 7+ years in office is increase the City budget from about $73 billion to $94 billion annually, in a time of little to no inflation. Another $20+ billion per year to the bureaucracy to accomplish absolutely nothing. It’s the very definition of progressivism.”

Last month, shortly after New York Mayor Bill de Blasio reached his seventh anniversary in office, I had a post giving him a “report card” on his achievements, or lack thereof. As you may know, de Blasio is term-limited at eight years, so he is now in his last year. In fact the contest to replace him is well under way, with the primary (that will likely determine the result) scheduled for June 22.

My February post on de Blasio covered subjects like taxes, spending, crime, schools, and rent regulation. On all of those, his performance has been abysmal, if not worse. But recently it occurred to me that the post had omitted to cover another subject that de Blasio himself has consistently emphasized as being his signature issue. That subject is income inequality.

How has de Blasio done on this issue? The answer is, disastrously. Despite — or maybe because of — de Blasio’s policy initiatives and greatly increased public spending, measured income inequality has actually increased. That result will of course not come as any surprise to Manhattan Contrarian readers. Things like income inequality are just not subject to cure, or even amelioration, by government tax-and-spend programs. So de Blasio’s failure was inevitable. But that has not stopped him and his supporters, let alone his most likely successors, from continuing to believe that the next round of such programs and spending is finally going to work.

The Palestinian Authority (PA) has been meeting with American, European and Israeli government representatives to end-run both the American Taylor Force Act (anti-“pay for slay”) and the Israeli law prohibiting financial transfers to the Palestinians in the amount the PA remunerates terrorist “salaries.” Why are Western governments having this discussion? Generally, the Israeli government treats the PA like a slightly leprous cousin—odious, but better than the cousin with guinea worm disease. There is a fear among some Westerners that if the PA loses control of its own people, then Hamas—the “worse” Palestinians, with both links to Iran and serious weapons—will make its move from Gaza to the West Bank.

It is not an unreasonable fear, but it undermines the rules of both money and morality.

Money doesn’t care where it’s spent—or by whom on what. While we talk about “dirty money” or “laundering money” to make it clean, the morality of money is with the people who spend it. People who spend money doing inoffensive—or even good—things with their money are still behaving immorally if their money helps bad people do bad things with other money.

It’s a sort of “money laundering” in reverse. If you can make dirty money clean, you can make clean money dirty. Good money becomes bad by virtue of its impact. And otherwise-good people become tainted by their willingness to help bad people do bad things.

A letter from House Intelligence Committee members demands answers from the DNI about illegal breaches of the wall guarding against CIA and NSA domestic activity.

A report declassified last Wednesday by the Department of Homeland Security is raising serious concerns about the possibly illegal involvement by the intelligence community in U.S. domestic political affairs.

Entitled “Domestic Violent Extremism Poses Heightened Threat in 2021,” the March 1 Report from the Director of National Intelligence states that it was prepared “in consultation with the Attorney General and Secretary of Homeland Security—and was drafted by the National Counterterrorism Center (NCTC), Federal Bureau of Investigation (FBI), and Department of Homeland Security (DHS), with contributions from the Central Intelligence Agency (CIA) and the Defense Intelligence Agency (DIA).”

Its primary point is this: “The IC [intelligence community] assesses that domestic violent extremists (DVEs) who are motivated by a range of ideologies and galvanized by recent political and societal events in the United States pose an elevated threat to the Homeland in 2021.” While asserting that “the most lethal” of these threats is posed by “racially or ethnically motivated violent extremists (RMVEs) and militia violent extremists (MVEs),” it makes clear that its target encompasses a wide range of groups from the left (Antifa, animal rights and environmental activists, pro-choice extremists and anarchists: “those who oppose capitalism and all forms of globalization”) to the right (sovereign citizen movements, anti-abortion activists and those deemed motivated by racial or ethnic hatreds).

The U.S. security state apparatus regards the agenda of “domestic violent extremists” as “derived from anti-government or anti-authority sentiment,” which includes “opposition to perceived economic, racial or social hierarchies.” In sum, to the Department of Homeland Security, an “extremist” is anyone who opposes the current prevailing ruling class and system for distributing power. Anyone they believe is prepared to use violence, intimidation or coercion in pursuit of these causes then becomes a “domestic violent extremist,” subject to a vast array of surveillance, monitoring and other forms of legal restrictions:

Yocheved, Moses’ mother, hid Moses and then breastfed him at the palace of Pharaoh, posing as a nursemaid.  Miriam was Moses’ older sister and advisor.  Batyah, the daughter of Pharaoh, saved and adopted Moses (Numbers 2:1-10).  Shifrah and Pou’ah, two Jewish midwives, risked their lives, sparing the lives of Jewish male babies, in violation of Pharaoh’s command (Numbers 1:15-19).  Tziporah, a daughter of Jethro and Moses’ wife, saved Moses’ life and set him back on the Jewish course (Numbers, 4:24-27).

Da’ye’noo Passover hymn and the US-Israel bond

Da’ye’noo (“it would suffice” in Hebrew) is a Passover hymn, which expresses appreciation for 15 benefits bestowed by God upon the Jewish people – though one benefit would have sufficed – such as the Exodus, the Parting of the Sea, the historical events at Mount Sinai, and the return to the Land of Israel.

The US-Israel bond may be assessed in a similar manner:
